Shares of online gaming firms hit the jackpot after the US Department of Justice revealed it now plans to free them from legislation that should only apply to sports betting.
As industry experts forecast the beginning of the end for online gambling prohibition in the US, Bwin.Party Digital Entertainment jumped 29.7p to 160p, 888 Holdings advanced 3.25p to 39.25p and Playtech 34.5p to 266p.
There is no doubt the new stance on the Wire Act of 1961 marks a huge shift for the Justice Department, which has previously proclaimed all forms of internet gambling – especially the increasingly popular online poker – are illegal.
The Wire Act, which banned gambling via telecommunications across state lines, has also been applied within states to prevent web-based betting.
But in recent months it has become evident the Justice Department was moving away from that strict interpretation.
In April Preet Bharara, the US Attorney in Manhattan, indicted 11 individuals in a crackdown on online poker websites and launched a £1.95bn civil lawsuit against firms including PokerStars and Full Tilt Poker, but did not include any Wire Act violations among the charges.
Rather, Bharara alleged the men had violated the Unlawful Internet Gambling Enforcement Act, which became law in 2006, and the Illegal Gambling Business Act.
And as the Justice Department now advises that the Wire Act does not apply to online poker, industry followers believe the way is clear for online gambling to proceed within state boundaries.
Broker Investec advised that the states of California, New Jersey, Nevada, Illinois, New Hampshire, Florida and Washington are in advanced discussions to open up gambling across state lines too, with regulation likely to take shape during the upcoming year.
A spokesman for Bwin.Party Digital Entertainment said: "It is an interesting step forward and we will continue to keep a close eye on the situation."
If individual US states are allowed to profit from online gambling, the federal government will soon take an increased interest in controlling and taxing the market rather than allowing a patchwork quilt to emerge.

Poker News Media: Andrey Pateychuk Wins WPT Prague - 6th December 2011

Andrey Pateychuk probably felt extremely lucky to even be at the World Poker Tour (WPT) Prague final table. This year’s European Poker Tour (EPT) San Remo Main Event champ found himself all-in with A-K late on Day 3, only to see his opponent flop a set of 9’s. The poker gods were with him, though, as he hit a runner-runner Broadway straight to double-up and eventually head to the final table in the third spot with over 2 million chips. He was still 4 million chips behind the chip leader, Stanislaw Kretz, and 2.5 million behind Benjamin Pollak, but no matter. Pateychuk ran through the final table Monday to win his second major tournament in less than two months, raking $630,263 in the process.
When the final table began, here was what the landscape looked like:
Stanislaw Kretz – 6,300,000
Benjamin Pollak – 4,865,000
Andrey Pateychuk – 2,310,000
Sigurd Eskelund – 1,575,000
Adria Balaguer – 1,315,000
Russell Carson – 725,000
As might have been expected, Russell Carson was the first to go. Having already lost some chips, he moved all-in pre-flop with 5-5 and Kretz made the call with Q-9. Kretz took the lead on the 9-6-3 flop, though the 8 on the turn gave Carson a shot at a gut-shot straight. It wasn’t to be, though, as the river blanked and Carson was eliminated in 6th place.
About a half hour later, Sigurd Eskelund raised pre-flop to 125,000, Pateychuk took it up to 285,000, and then Eskelund shoved for 1.46 million. Pateychuk quickly called, revealing pocket Jacks. Eskelund had K-Q and the race was on. The flop came down Q-8-6 and Eskelund was in control. Turn: 8. And then…the magical two-outer on the river for Pateychuk. With a rivered Jack, Pateychuk made a full house, shocking Eskelund and sending him home in 5th place.
Play didn’t necessarily slow after that, but it wasn’t for almost three hours that another player was eliminated. Adria Balaguer and Benjamin Pollak both got all their chips into the middle pre-flop, Balaguer with A-T and Pollak with J-9. The flop of J-7-4 put Pollak in the lead with top pair. And then, just like what happened to Pateychuk the previous day, Balaguer made runner-runner Broadway to snatch the pot away from Pollak, as well as many thousands of dollars.
The biggest hand for Pateychuk before heads-up came just before the dinner break. He raised to 200,000 pre-flop, only to see Kretz three-bet him to 560,000. Pateychuk did him one better, four-betting to 980,000, and rather than folding or just going all-in, Kretz called, creating one heck of a pot. Both players checked after the K-9-2 flop, but not after an Ace fell on the turn (which also created a flush possibility) – Kretz bet 1 million chips and Pateychuk made the call. Despite all that action, both players checked the 3 on the river. Pateychuk turned over pocket Kings for a flopped set and Kretz simply mucked. Pateychuk took the chip lead at that point with just over 6 million.
Not long after dinner, Kretz’s downfall was completed. He got it all-in after a Pateychuk raise and was called by the chip leader. Kretz held pocket 9’s, putting him ahead of the A-6 of Pateychuk. And now, since it’s Pateychuk, let’s skip to the river: an Ace. Kretz was knocked out in 3rd place, sending Pateychuk into heads-up play against Balaguer with a small lead, 8.004 million to 7.8 million.
Less than half an hour into heads-up, it looked like a Balaguer victory was imminent. Both men went all-in pre-flop and this time, Pateychuk couldn’t get lucky with A-5 versus Balaguer’s 8-8. When the smoke cleared, Balaguer had a huge lead, 15.63 million to just 1.5 million.
But on the very next hand, Pateychuck doubled-up to 3 million when his K-J held up against Balaguer’s T-9. Then, on the next hand, Pateychuk did it again, this time with A-K versus A-Q. He was still down, but with 6.3 million compared to Balaguer’s 10.8 million, things were looking up.
Within a few hands, another lucky river and some aggressive play gave Pateychuk back the lead, but soon thereafter, Balaguer brought it back to even. Appropriately, though, Pateychuk regained the lead for good when he outflopped Balaguer with A-6 against A-J. Really, at this point, Balaguer had to know that he had no chance. Pateychuk was playing good, aggressive poker, but with lady luck on his side, there was no stopping him.
On the final hand, Pateychuk raised pre-flop, Balaguer moved all-in with Q-Q, and Pateychuk called with A-5. Since this is the final hand, you can guess what happened. The flop was an all-spade 9-7-4 and, of course, Pateychuk held a spade. But that didn’t matter. The turn was a 3 and the river was a 2, giving him the wheel at the WPT Prague title. Despite all that action, both players checked the 3 on the river. Pateychuk turned over pocket Kings for a flopped set and Kretz simply mucked. Pateychuk took the chip lead at that point with just over 6 million.
Not long after dinner, Kretz’s downfall was completed. He got it all-in after a Pateychuk raise and was called by the chip leader. Kretz held pocket 9’s, putting him ahead of the A-6 of Pateychuk. And now, since it’s Pateychuk, let’s skip to the river: an Ace. Kretz was knocked out in 3rd place, sending Pateychuk into heads-up play against Balaguer with a small lead, 8.004 million to 7.8 million.
Less than half an hour into heads-up, it looked like a Balaguer victory was imminent. Both men went all-in pre-flop and this time, Pateychuk couldn’t get lucky with A-5 versus Balaguer’s 8-8. When the smoke cleared, Balaguer had a huge lead, 15.63 million to just 1.5 million.
But on the very next hand, Pateychuck doubled-up to 3 million when his K-J held up against Balaguer’s T-9. Then, on the next hand, Pateychuk did it again, this time with A-K versus A-Q. He was still down, but with 6.3 million compared to Balaguer’s 10.8 million, things were looking up.
Within a few hands, another lucky river and some aggressive play gave Pateychuk back the lead, but soon thereafter, Balaguer brought it back to even. Appropriately, though, Pateychuk regained the lead for good when he outflopped Balaguer with A-6 against A-J. Really, at this point, Balaguer had to know that he had no chance. Pateychuk was playing good, aggressive poker, but with lady luck on his side, there was no stopping him.
On the final hand, Pateychuk raised pre-flop, Balaguer moved all-in with Q-Q, and Pateychuk called with A-5. Since this is the final hand, you can guess what happened. The flop was an all-spade 9-7-4 and, of course, Pateychuk held a spade. But that didn’t matter. The turn was a 3 and the river was a 2, giving him the wheel at the WPT Prague title. Nov 23 - Playtech Ltd, the world's biggest provider of online gambling software, said it would raise 100 million pounds in a discounted offering to finance acquisition opportunities and investments in new joint ventures.
The placement of about 46.5 million shares would be priced at 215 pence each, representing a 2.5 percent discount to the stock's closing market price on Tuesday, Playtech said.
The company, in which its billionaire Israeli founder Teddy Sagi continues to hold a 40 percent stake, said it had identified a number of acquisition opportunities that would complement or expand its existing technology or product offering.
The cost of the opportunities currently under review vary in size up to about 40 million pounds.
Playtech is an Estonia-based company, which operates a joint venture with Britain's biggest bookmaker William Hill and provides software to Bwin.Party Digital Entertainment, Paddy Power and Gala Coral.
Shares of the company, which have lost a quarter of their value in the last three months, closed at 220.5 pence on Tuesday on the London Stock Exchange.

Stockholm, Sweden - Nyx Interactive AB ("Nyx") today announced the acquisition of NextGen Gaming Pty Ltd ("NextGen"), a leading independent provider of proprietary and branded slot games to the online and land-based gaming industry.
The businesses will merge to create a content-rich software provider combining NextGen's games catalogue and innovation in game design across the online, land-based, social and mobile distribution channels with the Nyx bingo, lottery and casino modules. The acquisition brings together two experienced international software providers leveraging their compatible customer base and complementary product offerings to deliver a broader roadmap of products and services to their customers. The combined business will own a catalogue of over 300 gaming titles with more than 40 customers and as a larger organisation is even better suited to meet the investment requirements of certain strategic regulated markets. Critically, the group will adopt a unified set of software standards enabling rapid delivery and distribution of content, including slots, table games, bingo, instant-win games and scratchcards to a notable customer-base that includes several World Lottery Association members, leading tier 1 operators and large casinos and sportsbooks. Furthermore, this will place the group in a strong position to profit from land-based casinos seeking to add an interactive offering to their portfolios.
The senior executive teams of both NextGen and Nyx will be combined, with games development continuing from the base in Sydney, software development and operations in Stockholm and certain client-facing roles and executive management in London.

Jim Ryan, the co-chief executive of Bwin.Party Digital Entertainment is a very busy man.
In fact, he's invested three of the past five weeks in the United States pushing a presentation that advertised to investors the strengths of the world’s largest publicly-traded online gambling - gaming firm. Ryan’s presentation included a one-page chart that listed the top online poker brands in the U.S. market. The names of once fierce competitors PokerStars and Full Tilt Poker, were crossed out in red. Is Party the only real game left in town? Time will tell.
“Where you see the red lines, those organizations have been indicted, so although one can’t predict the future, it’s unlikely you will see those brands back in the U.S.,” Ryan said during an interview. “The brand that has the most consumer awareness is in fact the PartyPoker brand.”
Ryan’s company happens to own both PartyPoker and the World Poker Tour, two of the top online poker brands that did not have their U.S. operations shut down by the U.S. Justice Department in April because they were not facilitating for-money online poker play in America—in the case of PartyPoker since 2006. They also own PartyCasino, a top online casino destination website. The fact that Ryan, who is based in Gibraltar, has recently been spending so much time in the U.S. demonstrates he is optimistic and hopeful for a U.S. comeback. “My focus is on the U.S.,” says Ryan, who is in the final stages of negotiating partnerships with two U.S. companies. “Even though there is no guarantee that online gaming will ever regulate in the U.S.”
For years Ryan and his staff at PartyGaming, which merged with Bwin earlier this year, had to sit on the sidelines, watching how much money PokerStars and Full Tilt Poker were snatching. It was a difficult thing to watch for the top brass and workers at PartyGaming, which was the biggest online gambling company in the world thanks to its domination of the U.S. online poker market until Congress passed the Unlawful Internet Gambling Enforcement Act in 2006. PartyGaming exited the U.S. market and saw its stock price take a massive hit, while PokerStars and Full Tilt kept their U.S. facing .com websites on air. Party competitors enjoyed somewhat of an unfair advantage, with the rouges using the U.S. market to expand globally at PartyGaming’s expense. “We were beyond the point of frustration,” says Ryan.
Next PartyGaming struck a non-prosecution agreement with the U.S. Attorney in Manhattan, paying $105 million and admitting its U.S. operations had for years violated U.S. law. Meanwhile, PokerStars and Full Tilt continued to operate in the U.S. and claimed that their U.S. operations did not violate U.S. law, pointing to legal opinions the companies had received from top American legal eagles. To many, it appeared like PartyGaming had given a lucrative business away. Even at the company’s headquarters there were doubts until April 2011, when federal prosecutors in Manhattan closed down the U.S. operations of PokerStars and Full Tilt, naming them illegal gambling businesses, and indicted some of their key execs. "I think Party has been vindicated now in getting out when they did and in dealing with the Department of Justice," says Behnam Dayanim, a partner at Axinn Veltrop & Harkrider, who negotiated PartyGaming’s agreement with federal prosecutors in downtown Manhattan.
With all that said, Bwin.Party Digital Entertainment is not exactly holding a management party quite yet. It's so close, yet so far, from reclaiming online poker’s crown. Operating in highly-regulated and taxed European markets while competing against well-run companies like PokerStars is not for the faint-hearted. Bwin.Party’s stock, which trades on the prestigious London Stock Exchange, has dipped by 50% in 2011. Big corporate mergers can be problematic, but the outfit has also suffered a setback in Germany, where the nation’s top civil court recently decided to uphold an online gambling ban, and been dissed by higher gaming duties across Europe. When the company attempted to take advantage of the April U.S. shutdown of PokerStars and Full Tilt, Bwin.Party found that while some new European players were attracted to its poker brands, revenues remained flat-ish. It wasn’t until Full Tilt’s European regulator suspended Full Tilt’s license in late June that Bwin.Party’s increased advertising and promotional expenditures started to pay dividends. PartyPoker is now the second-biggest online poker room in the world, according to PokerScout, averaging 4,150 cash players during any given time. PokerStars has 22,800.
Ryan, who joined PartyGaming as CEO in 2008, has been waiting for this moment for what seems like forever. He long ago took Bwin’s Norbert Teufelberger to a McDonald’s in La Linea, Spain, and chatted to him at length about the pros of combining Bwin’s strong online sportsbook business with PartyGaming’s poker brands, resulting in the merger that was first announced in 2010. Ryan also fine-tuned his company’s business-to-business capabilities over the last few years with an eye toward finding a U.S. partner with whom he can re-conquer America. "We had to be realistic about where we sat in the food chain," says Ryan. "We figured if the U.S. regulated it would be unlikely that we would secure a license directly, that the laws of the land would be written to allow existing land operators and equipment manufacturers in the U.S. to secure the licenses." Ryan is optimistic about current efforts in Washington, driven by the American Gaming Association and powerful casino companies like Caesars Entertainment and MGM Resorts, to potentially get some sort of online gambling legislation through a divided Congress. Ryan notes he is also preparing for the possibility that online poker gets regulated first on a state-by-state basis.
"We have to be ready for both federal or state," he says. "It feels good to have American taxpaying companies finally driving this.".
If an offshore operator is to succeed in American, Bwin.Party Digital Entertainment looks like the firm to place bets with.
Bwin.Party has identified Australia and New Zealand as places to further expand their business, even sponsoring high profile poker players such as Tony G and Stewart Scott (a former Crown Casino 'Aussie Millions' champion.) Bwin.Party’s stock, which trades on the prestigious London Stock Exchange, has dipped by 50% in 2011. Big corporate mergers can be problematic, but the outfit has also suffered a setback in Germany, where the nation’s top civil court recently decided to uphold an online gambling ban, and been dissed by higher gaming duties across Europe. When the company attempted to take advantage of the April U.S. shutdown of PokerStars and Full Tilt, Bwin.Party found that while some new European players were attracted to its poker brands, revenues remained flat-ish. It wasn’t until Full Tilt’s European regulator suspended Full Tilt’s license in late June that Bwin.Party’s increased advertising and promotional expenditures started to pay dividends. PartyPoker is now the second-biggest online poker room in the world, according to PokerScout, averaging 4,150 cash players during any given time. PokerStars has 22,800.
Ryan, who joined PartyGaming as CEO in 2008, has been waiting for this moment for what seems like forever. He long ago took Bwin’s Norbert Teufelberger to a McDonald’s in La Linea, Spain, and chatted to him at length about the pros of combining Bwin’s strong online sportsbook business with PartyGaming’s poker brands, resulting in the merger that was first announced in 2010. Ryan also fine-tuned his company’s business-to-business capabilities over the last few years with an eye toward finding a U.S. partner with whom he can re-conquer America. "We had to be realistic about where we sat in the food chain," says Ryan. "We figured if the U.S. regulated it would be unlikely that we would secure a license directly, that the laws of the land would be written to allow existing land operators and equipment manufacturers in the U.S. to secure the licenses." Ryan is optimistic about current efforts in Washington, driven by the American Gaming Association and powerful casino companies like Caesars Entertainment and MGM Resorts, to potentially get some sort of online gambling legislation through a divided Congress. Ryan notes he is also preparing for the possibility that online poker gets regulated first on a state-by-state basis.
"We have to be ready for both federal or state," he says. "It feels good to have American taxpaying companies finally driving this.".

As the €10,000 Championship Event of the 2011 World Series of Poker Europe enters its second Day One on Sunday, poker pros Michael “The Grinder” Mizrachi and Philippe Boucher captured the final two preliminary bracelets awarded on Saturday.
In the €10,000 Split Format No Limit Hold’em event, Mizrachi came back yesterday as a member of the Final Four who would determine the title. In his semi-final match against Roger Hairabedian, Michael slowly worked the heads up match to what was a startling conclusion. On the final hand of their matchup, Hairabedian flopped a set of fives on a J-8-5 board, but Mizrachi was able to best that by turning a straight with his 7-6 when a four found the turn. Once the board didn’t pair on the river, Michael Mizrachi was on to the final.
In the other semi-final match, Shawn Buchanan and Noah Schwartz battled it out for the right to face “The Grinder.” Buchanan methodically worked his way into a comfortable lead against Schwartz before getting him to commit his final chips with a mediocre offering. After a minimum raise from Shawn, Noah decided to make a three-bet stand for his last chips with only an A-5 off suit. Buchanan quickly called, tabling his pocket Kings, and once the board ran dry (albeit with a bit of a flush sweat), Shawn Buchanan was the winner of the match.
As predicted here yesterday, the Mizrachi/Buchanan battle was a fierce one, although Michael came to the felt with a 2:1 chip lead over Shawn. “The Grinder,” true to his name, was able to gradually add on to his lead over the two hours of play; nothing that Buchanan attempted seemed to work as his chip stack slowly slipped southward. The end of the tournament was particularly brutal for Buchanan as, holding an A-J against Mizrachi’s A-10, a ten came on the flop to flip the lead to Mizrachi. Turn and river deuces sealed the deal for the 2010 $50K Poker Players’ Champion, giving him his second bracelet in as many years.

The final table of the €1500 Six Handed Pot Limit Omaha tournament seemed to be more of a sprint than a marathon, highly unlike major championship final tables. Chile’s Nicolas Fierro came to the final table with the chip lead, but it was a one man wrecking ball by the name of Philippe Boucher who stole the show.
After taking almost an hour and a half before the first player, Jack Ellwood, was eliminated by Boucher, the Canadian pro would then storm his way through the remainder of the field. He would go on to knock off the entire table on his run to the title, only pausing slightly during heads up play against Michel Dattani. On the final hand, Dattani would commit his final chips holding an A-A-J-7 against the A-Q-10-9 of Boucher. After the board ran 6-6-8-J-Q to give him the winning straight, Philippe Boucher would pick up his first WSOP bracelet in just under four hours.

The campaign in the US for lawful online poker now has the backing of certain state reps from Massachusetts and the prospect of legalisation could open the gates for PKR to expand into a massive market.
The AGA had once condemned online gambling altogether and only changed their opinion due to reports of a threat of unregulated sites currently endangering American players. The prospect of US legalisation of online poker could be potentially huge for PKR as their fully regulated and licensed site already has the foundations to become a massive hit among gamers in the States.
Massachusetts state rep, Dan Winslow also added to the argument for legalisation by arguing the flailing US economy could benefit from the introduction of online poker because of the jobs it will create in game design and regulatory software upkeep - a notion America's 14 million unemployed will welcome.
Back in the UK, it's business as usual for PKR for the meantime but they are very excited by the suggestion of expanding their business across the pond. A spokesperson for the poker games site commented:
'It is still early days yet but it would be a massively exciting prospect to take PKR to the States. Crown Limited's Crown Casino unit has apparently abandoned its recent attempt to register its trademark in the U.K. following objections from the U.K.’s Crown Bingo, popular gaming title EGaming Review reported.
The Australian company, the largest gaming and casino operator in the southern hemisphere, sought to register the mark for "the provision of gaming and casino services over a global computer network".
Crown Bingo, of Newcastle-upon-Tyne, advised it would continue to oppose any attempt by the Australian company to use its brand in the United Kingdom.
"We’ve spent many millions on building the Crown brand in the U.K. and we don’t see why Crown Casino should benefit from that," Ian Erskine, Crown Bingo’s operations director told media.
