PartyGaming News Media Update - September 2009

PartyGaming Friday reported a less-than-expected 6.5% fall in first-half earnings, hurt by the stronger dollar against the pound and fierce poker competition online, and said second-half trading so far has been in line with management's expectations.

Chief Executive Jim Ryan advised trading in the three weeks ended 18th August, which represents the peak holiday season in most of the group's core markets, has been "strong," inline with management's business expectations.

Mr Ryan said the company's three-year strategy is on track and that it remains "confident about the group's prospects and look forward to the rest of the year with confidence."

Earnings before interest, tax, depreciation and amortization from continuing operations - the key figure watched by U.K. gaming analysts - fell 6.5% to $60.7 million in the first half to June 30, ahead of market expectations of $58.7 million. This compares with $64.9 million over the same period last year.

First-half net revenue dropped 21% to $201.3 million, inline with expectations, from $254.8 million a year earlier.

PartyGaming, the world's biggest listed-online gaming group by market capitalization, has been on the acquisition trail since its long-awaited settlement with U.S. authorities over its defunct gaming operations there in April.

Its first purchase was London-based bingo and casino operator Cashcade Ltd. for GBP95.9 million last month, and earlier this week it agreed to buy the bulk of WPT Enterprises Inc.'s operating assets for $12.3 million as well as 5% of the revenue generated by the assets.

Gibraltar-based PartyGaming didn't declare an interim dividend, in line with expectations, preferring to stock-pile money for "attractive consolidation opportunities." The U.K.-listed company hasn't paid a dividend since the U.S. government banned the online gaming industry in October 2006.

PartyGaming shares closed at 266 pence, valuing the company at GBP1.08 billion on the London Stock Exchange. The stock has risen 37% since January, fueled by its legal settlement with U.S. authorities and expansion plans.

PartyGaming's flagship brands are PartyCasino.com, PartyPoker.com, and is looking to ramp up its recent purchased brands, World Poker Tour and Foxy Bingo.

Emilio Gomez Steps Down from Party Gaming Board of Directors, by Jessica Welman - 27th September 2009

PartyGaming lost a member of its Board of Directors last week, when Non-Executive Directors Emilio Gomez stepped down from his post for personal reasons. The official statement from PartyGaming announcing his resignation made no mention of a future replacement and noted a balance between Executive and Non-Executive members of the Board in the wake of Gomez’s departure.

Now that Gomez has moved on, the Board consists of seven members, including Chief Executive Officer Jim Ryan, Non-Executive Chairman Rod Perry, and Finance Director Martin Weigold. Gomez first began his tenure as one of the group’s Non-Executive Directors in December of 2007 and served as the representative for Party Gaming co-founder Anurag Dikshit.

In December of 2008, Dikshit became the first online gambling mogul to face legal action in a U.S. Court when he agreed to forfeit $300 million in earnings from the company after admitting to breaking laws related to the Wire Act in conjunction with Party Gaming. In exchange for the monetary settlement, Dikshit avoided jail time until at least December of 2010 and continues to reside in Gibraltar, where Party Gaming is based. Dikshit stepped down from the Board of Directors in 2006 to serve as the company’s Head of Research and Special Projects. There has been no announcement as of yet as to how Gomez’s departure will influence Dikshit’s influence on the Board. Gomez’s resignation is just the latest in a long list of changes for PartyGaming this year. The company’s purchase of World Poker Tour Enterprises (WPTE) in August as well as numerous business-to-business ventures like the purchase of the online bingo company Cashcade and the launch of an Italian online poker site in tandem with Intralot have headlined a busy 2009 for PartyGaming. In its mid-year financial report, Ryan said the company would continue to pursue these profitable business-to-business deals and invest more time and effort in PartyCasino, its online casino business.

In the week following Gomez’s announcement, PRTY shares have seen a slight drop in value, falling from a high of $282 on September 23rd to a low of $263.80 towards the end of day on the 24th. At the close of the business day on Friday, shares were trading at $267.60. Despite the slight drop this week, PartyGaming stocks have been on a rise as a whole in 2009, increasing in value from $195 in January to a high of $283 in May to its current trading price of $267.60. France Set To Deliver Boost To U.K. Gambling - 23rd September 2009

PartyGaming Plc, William Hill Plc and 888 Holdings Plc, U.K. gambling companies facing a slowing market at home, may get a boost as neighboring France opens its online-betting market to foreign operators next year.

A bill that comes before the French parliament Oct. 7 would let foreign companies offer sports betting and poker, ending the monopolies of state lottery provider Groupe Francaise des Jeux and Pari Mutuel Urbain, which runs gambling on horseracing. All other online betting is currently banned.

British remote gambling industry worth US$1.4 billion - Swiss Press

The Gambling Commission released the results of detailed research showing that the remote gambling market in the nation was worth US$1.4 billion last year. In compiling its figures, the regulator revealed that it took detailed statistics from a range of sources including gambling industry trade bodies, the Department for Culture, Media And Sport and Her Majesty’s Revenue And Customs.

In addition, it stated that a ‘substantial’ amount of information was taken from
regulatory returns that all licensed gambling operators must submit on either an annual or quarterly basis.

The Commission stated that the UK gambling industry had a turnover of over US$136
billion in 2006/07 with gross gambling yield at around us$ 16 billion, one-quarter of
which was generated by the National Lottery.

The regulator revealed that the number of remote gambling licenses issued in 2008 rose from 300 to 328 with the majority of these consisting of betting exchanges alongside pool and general betting. “The majority of gambling sites accessible to British citizens are regulated overseas,” read the Commission’s results.

“In many cases an operator is licensed by the Commission for remote betting but (for
fiscal and other operational reasons) its remote casino and poker operations are
licensed overseas. The main European overseas jurisdictions regulating remote gambling are Alderney, Gibraltar, the Isle of Man and Malta.”

The Commission stated that the UK remote betting, bingo and casino industry employed
7,800 people in the country last year and had 6.2 million active customer accounts with 4.9 million new player registrations. It reported that there were a total of 16 million customer accounts holding around us$ 416 million.

Brititish online gambling sector valued at close to a billion sterling

The UK Gambling Commission has released some stats estimating that their remote (online) gambling market is worth approximately GBP 896 million (2008).

The Commission compiled information from gambling industry trade bodies, the Department for Culture, Media And Sport, and Her Majesty's Revenue and Customs, in arriving at the figure, in addition to information from its own regulatory returns submitted by operators.

The United Kingdom gambling industry as a whole achieved a turnover of over GBP 84 billion with gross gambling yield at approx GBP 9.9 billion, 25 percent of which was generated by the National Lottery.

The number of remote gambling licenses issued in 2008 rose from 300 to 328, with the majority of these consisting of betting exchanges alongside football pool and general betting.

"The majority of gambling sites accessible to British citizens are regulated overseas," the Commission pointed out.

EU Court Ruling Will Create Betting ‘Black Market’ Expert Warns - 19th September 2009

Hopes of online expansion by local gaming companies into the European betting market - which is seen to have as much potential for growth as the gambling-obsessed countries of the Far East - suffered a set-back last week when the European Court of Justice (the EU's highest court) ruled that governments could bar foreign gaming companies or bookmakers if they used the measure to combat fraud.

Europe's online betting industry is estimated to generate as much as eight billion euros a year, and the ruling followed an alleged breach of Portuguese law by the Gibraltar operations of Bwin and the Portuguese Football Federation in relation to sponsorship deals.

And it adds to the difficulties of online gaming companies - many of which are based on the Rock and provide a significant part of the local jobs market - which are attempting to win the legal right to expand their European operations.

FRAUD PREVENTION
There were fears that the ruling would allow European governments to use fraud prevention as an excuse to avoid opening markets to competition, an industry source told VOX. "It will not lead to job losses, but it will certainly curtail expansion," he said.

In a case brought by the Austrian operator Bwin - said to be one of the biggest online gaming companies in Europe - against the Portuguese state gambling monopoly, the judges ruled that European Union states should be allowed to restrict "freedom to provide services" in the gambling area if there was overriding public interest.

The court said prohibitions on online operators such as Bwin - one of Europe's biggest internet bookmakers - could be justified by the need to combat fraud and crime, "provided the restrictions were fairly applied and proportionate".

Although the court had previously accepted that national laws restricting gambling in an EU country could override the Union's general commitment to "freedom to provide services" principles, this was the first ECJ ruling to deal specifically with online sports betting.

"It represents a significant setback for online gaming companies, who have been battling for years to break down barriers preventing them doing business in many EU countries," Britain's influential Financial Times commented.

The case came in the wake of a sponsorship deal between Bwin's Gibraltar entity and the Portuguese football federation, which breached national laws and resulted in fines of about 75,000 euros each.

The European Court of Justice decided that online betting could be blocked in countries which operate state gambling monopolies such as Finland, Greece, Hungary, the Netherlands and Sweden. And in countries with more open gambling markets bookmakers will need licences.

"The prohibition imposed on operators... of offering games of chance via the Internet may be regarded as justified by the objective of combating fraud and crime," the Luxembourg-based court said in a statement.

It added that betting carried a high risk of fraud and that online betting carries an even greater risk of criminal activity, adding that bookmakers who sponsor competitions could "influence the outcome" of sporting events. (Although there has never been any suggestion of malpractice by the betting company, Bwin provided multi-million sponsorship for Spain's Real Madrid football club and Italy's AC Milan.)

A NEW ERA
The case in Portugal pitted Bwin, which has pumped millions of euros into such teams, against Lisbon's national gaming monopoly.

"You have to have a licence in a country to operate.... For me it is the beginning of a new era in the Internet gaming sector," said Friedrich Stickler, head of the European Lotteries association of state gaming organisations and a committed opponent of cyberspace gaming.

Stickler said there was now "room for legal action" against online bookmakers registered in Gibraltar, Malta, the Channel Islands and certain Caribbean territories which he accused of dodging taxes.

"Member states should investigate, because little tax is being paid in these tax havens and all these operators are avoiding paying gaming taxes in jurisdictions where the gamblers live," he said.

However, the European Gaming and Betting Association's legal expert Siegbert Alber argued the Court ruling was "not fair" because it lumped Bwin which is "a serious provider" together with "unscrupulous providers." The industry wanted harmonised EU online betting legislation and the ruling didn't solve the problem, he added.

"We need controls, but do we need monopoly to guarantee controls?"

Bwin director Karin Klein said online betting is "a market reality - prohibition won't work," and warned that EU states that refuse to allow online betting companies to operate "will end up with a huge black market."

More than a dozen similar challenges are in the pipeline at the European Court and could take a lead from last week's decision. The ruling could also have ramifications for about 10 cases brought by the European Commission, in which officials accuse individual countries of breaching EU principles through laws that protect state-owned gaming monopolies. As part of the Virgin Group, the London to Brighton charity bike ride is part of Virgin Games contribution to this goal.

Regularly offering their time and support to Kids Company, previous activities have included the Virgin Games team pulling together to redecorate an East London School and most recently arranging a sports day for children in Hackney. This year, the team of mixed cycling abilities will set off together at 8am and hope to reach their final destination of Brighton beach by 4 pm having raised Pounds Sterling 10,000 with all
stragglers accounted for! Keen cyclist Warren Eloff, Product Manager, who regularly cycles into work is tipped to lead the pack and CEO, Simon Burridge who is sitting on the saddle for the first time in 20 years, is set to surprise his team with his 'dusted down' cycling skills!
